Forest Adventure Club | Drop Off Sessions| Liability Waiver
PARTICIPANT AGREEMENT, INDEMNIFICATION, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY FOR DROP-OFF FOREST SCHOOL SESSIONS
Forest Adventure Club Leaders are First Aid trained, carry a first aid kit and complete regular risk assessments of sites and activities. In addition to this, on the spot safety assessments are conducted to ensure the natural area does not contain obvious hazards that pose immediate risks to the participants.
All of our Forest School Leaders, Assistants and Volunteers are required to read and follow Forest Adventure Club’s policies and procedures with regards to safety. We will work to do whatever we can to ensure the safety of our Forest School participants whilst delivering a programme true to the Forest School ethos in a natural setting. Despite our constant efforts to navigate and control risk, nature can be unpredictable.
In consideration of the services of Forest Club PTE. LTD. together with all agents, owners, managers, affiliates, sponsors, partners and participants, I, the undersigned adult listed below, hereby agree to release, indemnify, and discharge Forest Club PTE. LTD, trading as Forest Adventure Club, on behalf of myself, my spouse, my children, my parents and any other representatives as follows:
ASSUMPTION AND ACKNOWLEDGEMENT OF ALL RISKS
I am at least 18 years of age. On my own behalf, and on the behalf of the below listed participants under the age of 18 (“minors”), as their legal guardian knowingly, voluntarily, and freely accept and assume any and all risks, both known and unknown, of injuries or other loss or damage that may be suffered while my child participates in services offered by Forest Adventure Club, however caused. I represent that I have full authority as parent or legal guardian of the below listed minors.
I understand that risks simply cannot be eliminated in full, in view of the experiences provided by Forest Adventure Club and I expressly agree and promise to accept and assume all of the risks voluntarily existing in these activities by allowing my child to attend a Forest Adventure Club service.
Examples of activities that minors may be involved in include but are not limited to:
Tools use including sheath knives, bow saws, hammers, drills, loppers, secateurs and fire steels. Playing near or in shallow bodies of water such as streams, drains and wetlands. Rough and tumble play with other participants - following the identified rules for such hands on play. Playing with sticks, rocks, ropes, wood. Building and attending fires. Cooking over an open flame. Building temporary shelters with natural resources. Moving along uneven terrain which may include wet/slippery areas; rocky areas; muddy areas and areas with deadfall. Forest Adventure Club will supervise, assist and support children in such activities involving risk so that they may learn how to manage risk in a responsible manner.
I certify that the listed minors are in good physical condition for the activities in which they will be participating and certify that they do not have any medical condition that may preclude them from safely participating. Risks include, but are not limited to, insect bites, snake bites, falls, slips and trips, injuries resulting from uneven terrain, injuries resulting from falling branches, intoxication from poisonous berries, seeds and fungus and other flora, allergic reactions, scratches or bites from monkeys, cuts and lacerations from the mis-use of tools, burns from cooking fires, as well as more serious injuries (both acute and permanent) and in rare cases, death. Risks may occur from the changing natural environment including adverse weather conditions or from the mis-use of Forest Adventure Club’s equipment and materials or interaction with other participants in the experience. I feel that I have been adequately informed of the risks involved and I have had the opportunity to ask clarifying questions to further my understanding of these risks. Further, I have explained these risks to the listed minors.
WAIVER OF ALL CLAIMS
I, on the behalf of the listed minors, expressly and voluntarily agree to waive any and all claims, suits or demands for personal injury, property damage or other loss against Forest Adventure Club, including but not limited to any and all negligence, negligent supervision and/or negligent instruction, faulty equipment, or the activities of others. To the fullest extent permitted by law, this waiver is intended to be a complete release of Forest Adventure Club for any and all responsibility for personal injuries, property damage or loss, or death sustained by any of the listed minors whilst attending a Forest Adventure Club experience, whether arising out of or resulting from their participation in activities, the natural environment or mis-use of equipment and materials provided by Forest Adventure Club.
This release applies forever, for any date in the future including today’s date, that the listed minors may attend a Forest Adventure Club experience, and is further binding on the heirs, representatives and estates of the undersigned and minors.
MEDICAL AID AND EXPENSES
I expressly and voluntarily agree to waive, release, acquit and forever discharge Forest Adventure Club and agree to defend, indemnify and hold harmless Forest Adventure Club from and against all claims, damages, injuries, expenses, or death arising out of or resulting from administering of or failing to administer first aid to any of the listed minors.
I certify that I have adequate insurance to cover any injury or damage that the listed minors may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I grant Forest Adventure Club the right to request emergency medical services for the listed minors in the event Forest Adventure Club deem a situation medically necessary and I agree to cover any and all associated expenses.
APPROPRIATE CLOTHING AND PROVISIONS
I understand that it is my responsibility to ensure that my child is dressed appropriately for each activity to support in protecting against weather, mosquito bites, ant bites etc. I acknowledge that I have been briefed on the recommended attire, detailed in the Forest Adventure Club Parent Handbook, which includes but is not limited to long sleeve tops, long sleeve trousers, closed toe shoes, socks and waterproofs.
I agree to ensure that my child begins each session with a full 500ml bottle of water and one (nut free) snack, as a minimum to minimise dehydration and provide nourishment for the active sessions.
I will provide mosquito repellant and or repellant stickers for my child. I give my permission for my child to have mosquito repellant applied, when necessary to protect against mosquitoes.
Due to the location and nature of our Forest School sessions, the weather has the potential to impact participants’ safety. I recognise that Forest Adventure Club reserves the right to cancel/implement alternative activities in the event of inclement and undesirable weather or other unforeseen circumstances. I give my permission for my child to have sun cream applied, when necessary to support in protecting against sunburn. If minors are known to have allergies to any sun cream then adults should undertake to provide appropriate sun protection.
PHOTOGRAPHS AND VIDEO CONSENT
I understand that Forest Adventure Club will take both photographs and videos of the children while participating in sessions for the purposes of sharing these photos and videos with yourself as a means of Parent/Carer communication and also for promoting the business of Forest Adventure Club on social media platforms, website publications and marketing material. I give consent for this to take place. I am free to and will inform Forest Adventure Club separately should I wish to withdraw consent. Consent is not a precondition to accepting children into the programme.
I, for the listed minors as their parent, legal guardian or legally authorized custodian, have carefully read this agreement, fully understand its terms, and sign it freely and voluntarily. I understand that I have given up substantial rights by signing it, and agree to be bound by its terms for myself and on behalf of the listed minors. If any portion of this agreement is found to be void or unenforceable by Singapore law, the remaining portion shall remain in full force and effect.
Information provided will strictly not be shared to third parties for marketing or other such gain. It is solely to establish proof of consent to the terms of this waiver.
